The second way to attack a class action is by persuading the court not to certify the class of prospective plaintiffs. This can be done by showing that the plaintiffs do not have claims in common, or that it would be inappropriate to lump all of the plaintiffs together in one case.
Another way a business can head off a class action before trial is by settling the case. While this is not the preferred course of action for most businesses — especially if it may inspire copycat litigation — it may be the best option if the business needs to minimize costs or do something to salvage its reputation.
